Notice on suspension of time limits related to the payment of fees and performing of actions

Provisions of the Law on Fees, Patent Law, Design Law and Trademark Law provide that after announcement of the state of emergency or quarantine in the whole territory of the Republic of Lithuania and therefore imposing restrictions related to free movement of persons or freedom of economic activities, time limits for payment of fees and performing of actions, provided by said Laws, are suspended.

Established suspension of payment of fees and time limits applies:

  • for time limits which have not yet expired on the date of entry into force of the Resolution of the Government of the Republic of Lithuania No. 1418 on Announcement of the quarantine in the territory of the Republic of Lithuania, adopted on December 14, 2020 and
  • for time limits, which have started after this Resolution has entered into force.

Resolution has entered into force as from December 16, 2020 and restrictions related to free movement of persons or freedom of economic activities is announced until January 31, 2021.

Tool for calculation of suspended terms:

Established suspension of payment of the fees and time limits shall apply until withdrawal of restrictions related to free movement of persons or freedom of economic activities in the Republic of Lithuania. Date of withdrawal of suspension will be announced by a separate notification of the State Patent Bureau.

Suspension of payment of the fees and time limits means extension of these terms for the period equal to the period of suspension. Actions, for which time limits are suspended, may be performed after renewal of these time limits within the number of days for which the time limits have been suspended.

Time limits provided by the Laws for actions performed by the State Patent Bureau shall not be suspended.

Please note that there will be no individual notifications regarding suspension and recalculation of the time limits. Obligation imposed by the Laws for the applicants, owners of industrial property objects and any other interested persons to perform actions according to the time limits provided by Laws shall remain valid (by individually evaluating provisions of the Laws regarding suspension of the time limits and calculation of the time limits applied in a particular case).

Suspension of the time limits does not prevent applicants, owners of industrial property objects or any other interested persons from performing necessary actions within the time limits set by the laws, if they are able to do so.
